Chinese MAK-90 Contraband "Third Pin" Rifle

Over the years I have seen many people ask about the Chinese MAK-90 rifles that came into the country in the early 90s, and were subsequently "collected" by the BATFE.

Special thanks to "Dutchkma" and his personal first-hand experience with one of the "special" rifles. These pictures are probably the only ones in existence which closely detail the specifications.

These MAK-90 rifles were declared "contraband" by the the BATFE because of the third pin hole in the receiver. Even though they had a rivit installed in the third hole, they are still contraband because of the third hole. "Once a machinegun, always a machinegun."

I actually handled one of these back in Colorado Springs, Colorado at the local gunshow and a dealer friend of mine said to stay away from them because they were "ATF Bait."

If you run across one of these rifles for sale.....admire it.....handle it......but don't buy it. There is no way it will ever be legal to own.

Do you mean, how many have had the FA parts put in by their owners? Almost none of them. It would be a big mistake to do so: without the FA parts a person could claim ignorance of the 3rd hole, and if caught by the cops could probably escape with the loss of the rifle and maybe some legal fees. Full conversion would be no different than if you made a machinegun under any other circumstance.

There is no way for a regular citizen to make them legal. Someone could theoretically weld the hole and refinish the gun and maybe make it pass for legal (which would be a really crappy thing to do to some future buyer), but as far as the BATF is concerned, once a machinegun...
The receiver is a machine gun, doesn't matter what parts are inside
Ok, I have been told about the 3rd hole many times but, No one ever defines as to why. If you have a 3rd hole, is it a automatic rifle w/o adding anything else. I'm kinda new at this so thats why I ask. What do you have to add to make it a automatic rifle?

The third hole holds the pin for the auto sear on a AK. So to be a auto AK it has to have or had a third hole...once you have had a third hole in a AK receiver the ATF considers it a machine gun whether the other parts required are installed or not as the gun is now readily convertible to full auto use by the relatively easy addition of the other required items. In their view a person could install parts and have a machine gun one day and remove the parts and viola no longer have a machine gun. By making the rule that 3rd hole = machine gun and once a machine gun always a machine gun it prevents people from converting a gun playing around with it and then Un-converting it to be legal once again to preserve the value of the gun and restore legality. In short if you drill the third hole it is forever a machine gun , illegal to possess or sell...this prevents people from playing Nana-nana-nana with the ATF, catch me with it configured as a machine gun if you can.

This is the same reason it is illegal to build a semi auto that fires from a open bolt and illegal to own a unregistered AR15 "lightning link" or drop in auto sear (DIAS) or an AR15 lower with a sear pin hole drilled.

Holy crap, I didn't realize these even have slotted rails that were blocked! I can't imagine the size of the new asshole that must have been ripped into the poor bastard agent(s) that approved a shipment of AK's with a third hole, full auto selector markings, and slotted rail...
Somewhat related, there's a "AK 47 Post 86 dealer sample" on gunjoker right now that looks suspiciously like a Type 56, but the photos were taken with a Nikon potato and the description really stinks.
These have to be pretty much gone by now, methinks.
they still pop up..most people who have them dont have a clue what they are..been sitting in a closet or their dads gun safe for years...
Am sure there are lots of third hole rifles out there as well as other contraband and evil features; have yet to see anyone bothered at a gun range with even obvious bad stuff let alone less obvious items. not saying it won't or can't happen just saying it has to be pretty rare unless you are publicizing it. Of course, I for one would never take the chance! m

Yep, there still out there. Seen a couple unregistered clayco imports pop up in the last year.

Yeah, both that and the apparent acid jizz all over it would be indicators to avoid...

The jizz was grease the gun was matching # unfired and could have bought it for $650 broke my heart to leave without it.
