Chinese MAK-90 Contraband "Third Pin" Rifle

Over the years I have seen many people ask about the Chinese MAK-90 rifles that came into the country in the early 90s, and were subsequently "collected" by the BATFE.

Special thanks to "Dutchkma" and his personal first-hand experience with one of the "special" rifles. These pictures are probably the only ones in existence which closely detail the specifications.

These MAK-90 rifles were declared "contraband" by the the BATFE because of the third pin hole in the receiver. Even though they had a rivit installed in the third hole, they are still contraband because of the third hole. "Once a machinegun, always a machinegun."

I actually handled one of these back in Colorado Springs, Colorado at the local gunshow and a dealer friend of mine said to stay away from them because they were "ATF Bait."

If you run across one of these rifles for sale.....admire it.....handle it......but don't buy it. There is no way it will ever be legal to own.

So what about tigging the hole? Would that make it legal? I'm looking at a mak 90at a dealer, don't know if it has that hole,now I'll have to check that out.

The destruct pictures are a helpful example for SOT's. They offer proof of destruction that should satisfy the ATF.

Someone asked a question about an SOT registering them as a post-May dealer sample. I believe that there is a catch-22. You need a Law Enforcement demo letter to buy one as a dealer. If you already own one without the letter, you are technically in violation. If you have a letter and buy one, that should be allowed.

Actually they are illegal, and can't be transfered to anyone. They are contraban and should be destroyed no matter who owns them.
Yikes, and to think that I was looking at several chinese ak's and had no idea that there was a third hole.

If you ask me, the people who try to sell them to unsuspecting buyers should be thrown out of the gun show, I bet you $20 that if you told the gun show owner about this they would be out of there like shit through a goose. Don't need any "THEY WERE SELLING MACHINE GUNS" media publicity ya know.
A C3 couldn't manufacture/register it, but a C2 could...no letter required. :twisted:
OK so doesnt this mean anyone with a Mak 90 could drill a hole there and install a pin??? I know everyone is saying if it has the sear pin, stay away.....but I am just saying if JOe BLOW wanted to, couldnt he just add that to his semi-auto mak 90?? I am sure there is more to it in order to make it fully auto, but I cant help but think that drill bits are everywhere LOL!!

It's not just a MAK90, but one can drill a hole in almost any AK....

It's not just a MAK90, but one can drill a hole in almost any AK....
The rail still needs to be slotted for the safety sear though.
How sure are you guys of "once a machine gun always a machine gun?" District of Columbia court of appeals seems to contradict that. Here's the link to the lawsuit by VJ Vollmer in which he not only prevails, but also wins court costs.

These are still out there; I just handled one at the Spokane gunshow. I seemed to attract the attention of a 'third party'. [The only time it happened at the show.]

I was inspecting the 3-pin 'LABANU' marked Mak90 when a man poked his head in and asked: "What are they getting for those now?"

I turned and said: "About 10 to 25". :lol:

The vendor in question seemed detatched, and did not recognise me in any way while I examined the rifle on the table; No 'howareya' or 'that'sa rare preban' or 'youcan pick that up' or anything. Like the rifle and I were invisible.
I have been interested in putting together a Chinese rifle for awhile, just for the fun of it, and last night I came across a Gunbroker auction that besides the price, looked pretty good. While reserching on Receiver Types and Specs, I saw this thread. Anyway, Gunbroker Auction # 160230012, he references full auto to much for comfort. Is this one of these 3 pin rifles and if so are the parts Toxic. Could a legal version be built from these parts, or are they worthless, because of the ATF once an MG always an MG rule?

Legit kit - IACO was an early importer out of Sacramento,CA and there is nothing illegal about this kit...no receiver, no MG. It's not illegal to possess F/A FCG parts or anything and since this is a parts kit w/o receiver, it's good to go. Most kits that come in were once select-fire and so long as you don't have a receiver with the 3rd pin hole and/or auto-sear slot, there's nothing to worry about. Just a cut up pre-ban Norinco 56S-1 and could have been one from the batch that Akron Armory had for sale years ago.
I have one of these kits. I was wondering why the selector stop was short. Now I know.

Just came back from a fun show in Tucson, came across not one but two! Old guy running the stand had no idea and started giving me some realllll dirty looks when I started mentioning the third hole. Beware, they're still out there.
